Suspect cold-cocks woman, bops officer with own baton

A Cathedral City woman’s ex-boyfriend broke into her home, tried to kidnap her and then later fought with officers, a police spokesman said today.

David Rush, 40, is accused of breaking into her home at about 11:20 a.m. Saturday in the 31-200 block of Landau Boulevard. He tried to force her to leave with him, but she refused to go, according to Cathedral City police Sgt. Corwin de Veas.

When she attempted to call 911, Rush punched her so hard that he knocked her out, and then he fled with her cell phone, de Veas said.

At about 2:15 p.m., two officers located Rush at Ramon Road and Date Palm Drive, and when the first officer tried to arrest him, the two began to fight. Rush grabbed the officer’s baton and began hitting him with it before the second officer used a Taser to subdue the suspect, de Veas said.

Rush was arrested and booked into the Larry D. Smith Correctional Facility in Banning for suspicion of spousal battery, attempted kidnapping, assault and battery on a police officer, resisting arrest, possession of a dangerous weapon, and breaking and entry with intent to commit a felony.

Rush was held in lieu of $1 million bail, and a court date was set for Wednesday in Indio, jail records showed.

    Back when i went to the police academy, we were taught that when someone is able to take your baton from you and starts beating you with it, shoot the SOB before he incapacitates you!

    Also, can someone at Cat City PD explain why the POS SOB wasn’t charged with 245c PC (Assault with a Deadly Weapon not a firearm on a peace officer)?
