An ex-boyfriend of Halle Berry was arrested today after getting into a fistfight with her fiance outside the Academy Award-winning actress’ Hollywood Hills home, Los Angeles police said.
Canadian model Gabriel Aubry, 37, was later released on $20,000 bail after being charged with misdemeanor battery following the confrontation with Berry’s fiance, actor Olivier Martinez, 46, in the driveway of her home.
The altercation occurred during a custodial hand-off involving Berry’s 4-year-old daughter with Aubry, Nahla, according to Los Angeles police officer Julie Boyer of the Hollywood Division.
Martinez was restrained by Berry’s private security detail shortly after 10 a.m.
Following the scuffle, Aubry and Martinez were both taken to Cedars-Sinai Medical Center with “non-life-threatening injuries,” Boyer said.
After being treated, Los Angeles officers transported Aubry to the Metropolitan Detention Center where he was booked at 2:30 p.m.
He was released shortly before 6:30 p.m. after making bail. He is due in court on Dec. 13.
A judge has since issued an emergency protective order requiring Aubry to stay at least 100 yards from Berry, their daughter and Martinez, according to celebrity website, TMZ.com.
Aubry and Berry, 46, have been engaged in a bitter custody dispute since they broke up in April 2010 after five years together.
Earlier this month, a judge denied Berry’s request to move to France with Nahla.
Berry and Martinez, who is from France, met while filming the movie ”Dark Tide.”
They announced their engagement in March.
