Lindsay Lohan flew from New York to Los Angeles early today, apparently fearful she would be ordered arrested if she did show up at a pretrial hearing in a case alleging she lied to Santa Monica police.
The 26-year-old actress had claimed through a New York attorney that she could not be at the Airport courthouse this morning as ordered because of a respiratory infection.
But she and her mother, Dina, took the last flight out of JFK last night, flying first class on an American Airlines jetliner that landed at LAX around 12:30 a.m., the celebrity news website TMZ.com reported.
Lohan was charged by the Santa Monica City Attorney’s Office on Nov. 29 with willfully resisting, obstructing or delaying an officer, providing false information to an officer, and reckless driving.
The misdemeanors each carry potential jail terms ranging from three months to a year.
Lohan was already on probation because of the theft of a necklace from a Venice jewelry store and now stands accused of violating the terms of her probation, which ultimately could send her to jail.
Through an attorney, Lohan pleaded not guilty on Jan. 15 to the charges, which accuse her of lying to police by telling Santa Monica officers she was not driving a Porsche that rear-ended a truck on Pacific Coast Highway on June 8 as she headed for work on the TV film “Liz & Dick.”
During the arraignment, which Lohan did not attend, Superior Court Commissioner Jane Godfrey ordered the actress to personally appear in court for today’s hearing.
Lohan’s new attorney — New York-based Mark Heller — filed court papers asserting the actress was suffering from an upper respiratory infection and could not fly to California for the hearing.
TMZ posted photos of Lohan shopping in New York on Saturday, the day she was allegedly examined by the doctor who diagnosed her infection. One of the photos shows her smoking a cigarette.
The photos apparently triggered panic, prompting Lohan’s return, according to TMZ.
