Fanatics South Dakota sports betting does not exist, and the reason has nothing to do with how fast Fanatics has been expanding elsewhere — the brand added 23 states plus D.C. by inheriting PointsBet’s licenses, but South Dakota was never one of them, and the state’s one brand-name Deadwood seat belongs to BetMGM. What South Dakota does have is a working Fanatics app of a different kind: Fanatics Markets, the company’s prediction-contract platform, which beat the sportsbook here by arriving in the state’s very first rollout wave in December 2025.
Is Fanatics Legal in South Dakota? Not as a Sportsbook
South Dakota voters approved Constitutional Amendment B in November 2020, authorizing the Legislature to permit sports wagering only within Deadwood’s city limits, plus tribal casinos under their own compacts. Senate Bill 44 followed, signed by Governor Kristi Noem on March 18, 2021, putting the South Dakota Commission on Gaming in charge of licensing Deadwood properties one at a time rather than running a statewide operator bid. When the market opened September 9, 2021, the brand-name seat went to BetMGM, through an exclusive Liv Hospitality partnership covering Tin Lizzie Gaming Resort and Cadillac Jack’s Gaming Resort. Fanatics — or PointsBet, before the 2024 acquisition — never struck a comparable deal.
No license category exists for a mobile-only book: Even if Fanatics wanted in, SB 44 only licenses retail sportsbooks tied to a specific Deadwood or tribal casino floor. There is no statewide mobile-betting application to file, which is a bigger obstacle than any single missed deal.
Markets Got Here First
The twist is that Fanatics already runs one real product in South Dakota. Fanatics Markets — a prediction-contract trading app, not a sportsbook — launched December 3, 2025 as part of the company’s first wave of ten states, a list built specifically around places with little or no existing real-money sportsbook access: South Dakota, Hawaii, Idaho, and a handful of others. Trades price and clear through Crypto.com | Derivatives North America, a CFTC-registered exchange, with distribution through Paragon Global Markets, the NFA-registered introducing broker Fanatics acquired in 2025. That is federal commodities infrastructure, the same general lane Kalshi operates in — not a South Dakota gaming license, and not an answer to the sportsbook question.
Two different Fanatics products, two different rules:
Fanatics Sportsbook: No South Dakota license, no statewide mobile-betting law to plug into. Restricted.
Fanatics Markets: Live since December 3, 2025, operating under federal exchange rules rather than SB 44. Separate legal category entirely.
Is Fanatics Legit, Even With No Sportsbook Here?
Yes — South Dakota’s absence is about market structure, not any mark against the company. Fanatics Betting and Gaming runs a regulated sportsbook in 23 states plus D.C. on licenses it inherited in the $225 million PointsBet deal that closed April 2024, the same kind of multi-state operating record DraftKings and FanDuel can point to. None of those three has a Deadwood deal either; South Dakota’s casino-by-casino licensing model has simply never produced one for any national sportsbook brand except BetMGM.
The 2026 Vote That Would Have Opened a Door
Senate Joint Resolution 504 would have asked South Dakotans in November 2026 to approve statewide mobile wagering, routed through Deadwood-based servers — a structure that could have let Fanatics in without needing its own Deadwood casino partnership. It passed the Senate 23-10 on February 11, 2026. The House State Affairs Committee rejected it 11-2 on March 4, 2026, keeping it off this year’s ballot and leaving the sportsbook question exactly where it started.
Who It Fits
Nobody in South Dakota gets a Fanatics sportsbook today, and the only way to legally bet on a game here is in person at a Deadwood or tribal casino that holds its own license — currently not Fanatics. Anyone curious about Fanatics Markets is looking at a different, already-live product with its own federal rules, not a workaround for sports wagering. 21+ only; the South Dakota Problem Gambling helpline is 1-888-781-4357.
