FanDuel Colorado has run as a licensed online sportsbook since May 1, 2020, one of the first five states where FanDuel went live after Colorado voters authorized the industry. It got there in an unusual way: there was no clean yes-or-no vote on sports betting by itself, and there is still no FanDuel retail sportsbook anywhere in the state.
Is FanDuel Legal in Colorado?
Yes, but the law it runs on barely passed. Proposition DD, the November 2019 ballot measure that legalized sports betting statewide, cleared by roughly 51% to 49% — one of the narrowest sports-betting votes of the entire 2018–2026 expansion era. It didn't create a standalone online license. Instead it bolted mobile and retail sports wagering onto Colorado's existing limited-stakes casino framework, which confines licensed gaming to three old mining towns: Black Hawk, Central City, and Cripple Creek. An online-only operator like FanDuel gets in through a market-access partnership with one of those casinos rather than a license to stand alone.
FanDuel's Colorado license: market access through a Black Hawk casino operator — Twin River Worldwide Holdings at the May 2020 launch, since rebranded Bally's Corporation. Retail sportsbook: none; FanDuel never opened a physical counter in Colorado. Regulator: Colorado Division of Gaming, under the Limited Gaming Control Commission.
The Free-Bet Tax Break Is Disappearing in 2026
Colorado taxes sports betting at 10% of net proceeds, with the money earmarked for water projects through the Colorado Water Plan — the detail that helped Prop DD squeak through in 2019. For years, operators including FanDuel could shrink that taxable number by deducting the value of promotional bonus bets they handed out. That break is being phased out. Under HB25-1311, signed by Governor Jared Polis in May 2025, the deduction cap fell to 2% of handle for the back half of 2025, drops to 1% for January through June 2026, and disappears completely on July 1, 2026. The state's own fiscal note projected roughly $12.9 million in additional tax revenue from the change in its first full year.
None of that changes what a Colorado bettor sees at sign-up — FanDuel's bonus-bet structure is a national offer, not a state-specific one. What changes is how much of that bonus value FanDuel gets to write off its Colorado tax bill, which is a regulator-and-revenue story, not a player-facing one.
Is FanDuel Safe in Colorado?
Yes, in the sense that matters for a bettor: the Colorado Division of Gaming, operating under the Limited Gaming Control Commission, licenses and audits FanDuel the same way it licenses every retail casino floor in Black Hawk, Central City, and Cripple Creek. Geolocation enforces the state line before a wager is accepted, and the master-licensee structure means FanDuel's Colorado operation is tied to a named, regulated casino partner — not a free-floating app with no local accountability.
No FanDuel Casino Here
Proposition DD only ever authorized sports betting. Colorado has no legal online casino market of any kind, for any brand, so this isn't a FanDuel-specific gap. Slots and table games stay confined to the three limited-stakes mountain towns in person. FanDuel Casino nationally exists in just five states — Connecticut, Michigan, New Jersey, Pennsylvania, West Virginia — and Colorado misses that list for a structural reason, not an oversight.
Who It Fits
Adults 21+ in Colorado get a fully licensed FanDuel sportsbook with six years of track record and a named regulator behind it. The tax fight over free-bet deductions is a state-revenue story worth knowing, not a reason to doubt the book's legitimacy. Treat every wager as entertainment spending, not income.
