FanDuel North Dakota isn’t stuck behind a slow regulator or an unresolved tribal compact fight — the state constitution simply doesn’t recognize commercial sports betting as something anyone outside a tribal casino can offer. A 2025 attempt to change that died in the House by a 70-24 vote, and the Legislature won’t meet again in regular session until 2027. That calendar, more than any company decision, is the whole story here.
No Carve-Out, No License Category
Most states that lack a FanDuel sportsbook at least have a licensing process a company could theoretically enter. North Dakota doesn’t. Outside the handful of charitable games nonprofits run — bingo, raffles, pull-tabs — and the state lottery, gambling isn’t authorized by the constitution. Sports wagering, mobile or retail, needs its own constitutional amendment before any statewide license can exist, and amending the constitution starts with a resolution in the Legislative Assembly, which meets only every other year, in odd years.
HCR 3002, January 22, 2025: Rep. Scott Louser’s resolution would have sent a statewide sports-betting question to voters in November 2026, with projected revenue earmarked for K-12 education. It failed on second reading 70-24 — not a close vote.
Is FanDuel Legal in North Dakota?
No, and not because FanDuel hasn’t applied. There is nothing to apply for. Opponents of HCR 3002, including Rep. Lawrence Klemin, argued a new mobile market would pull money away from the charitable gambling nonprofits already rely on, and North Dakota University System representatives testified against it on problem-gambling grounds. Those objections carried the vote by a wide margin, and nothing on the 2026 legislative calendar revisits it — the Assembly simply isn’t in session this year.
The Only Legal Sportsbook Is Tribal, and In Person
A handful of North Dakota’s tribal casinos run retail sportsbooks under compacts negotiated individually with the state, separate from any statewide licensing scheme. That’s the entire legal sports-betting market in North Dakota today: walk-up, in-person wagering at a specific property. No tribe or anyone else holds a FanDuel license, and there is no mobile or online product tied to any of these compacts.
Three failed attempts: Sports-betting resolutions or bills have come up in 2021, 2023, and 2025. Each one stalled or failed outright. The earliest a FanDuel sportsbook could legally exist here is a 2027 resolution followed by a November 2028 statewide vote — and that assumes 2027 succeeds where the last three sessions didn’t.
Is FanDuel Safe for North Dakota Players?
The honest answer is the one that applies anywhere FanDuel has no licensed product: there’s nothing here to use unsafely. FanDuel’s sportsbook carries a clean regulatory record across the 24-plus states and D.C. where it actually operates under a state license. North Dakota’s absence from that list reflects a constitutional gap the Legislature keeps declining to close, not any doubt about the company.
Who It Fits
Nobody gets a FanDuel sportsbook in North Dakota today. A resident who wants to bet legally has exactly one option: an in-person wager at a tribal casino running its own retail book. That won’t change until the Legislative Assembly reconvenes in 2027 and sends a fourth attempt to voters — and gets a different result than 2021, 2023, or 2025.
