Is Kalshi Legal in Rhode Island? Two Suits, No Ruling

Neronha filed his own suit the same day, arguing the opposite in Superior Court and citing an 8% drop in Sportsbook RI’s betting handle from 2024 to 2025 as evidence that event contracts are cutting into the state’s own market. Rhode Island agreed to pause its state case while the federal one proceeds, which is the one that actually matters right now.

The CFTC didn’t just back Kalshi — it sued the state. On May 28, 2026, the CFTC moved to intervene and sue Attorney General Neronha and Rhode Island Lottery director Mark Curcolo directly, arguing it holds exclusive federal jurisdiction over event contracts. That made Rhode Island the seventh state the CFTC has sued in this fight. Judge Mary S. McElroy heard oral argument on Kalshi’s injunction request on July 16, 2026; no ruling had come down as of this writing.

Is Kalshi Legit in Rhode Island?

As a company, nothing about Rhode Island’s lawsuits changes the baseline: CFTC designation since 2020, KYC-verified accounts, dollar settlement. What’s actually in dispute is jurisdiction — whether a state gambling statute written for Sportsbook RI reaches a federally regulated exchange — not whether Kalshi honors a trade that resolves in a customer’s favor.

How Safe Is Kalshi for Rhode Island Traders Right Now?

Safe in the CFTC-oversight sense — KYC, dollar settlement, federal designation — not in the sense of a Rhode Island Lottery seal of approval, since the Lottery’s own licensing authority stops at Sportsbook RI.
