Most BetMGM Delaware searches are really asking about one missing sportsbook. The real answer is bigger than that: Delaware runs online sports betting, online casino, and online poker as a single Lottery-owned monopoly, and one company holds the exclusive contract for all three. That company has never been BetMGM.

Is BetMGM Legal in Delaware? Three Verticals, One Vendor

Delaware could move fast on sports betting in 2018 because the legal groundwork was already sitting in 29 Del. Code Chapter 48, which gives the Director of the Delaware Lottery Office licensing and rulemaking authority. Online casino and poker followed a similar path years earlier — the state ran them with 888 Holdings' technology starting in 2013, long before most states had any online casino product at all. In August 2023, the Lottery handed the whole stack to a new exclusive partner: Rush Street Interactive, operating every regulated online vertical under the BetRivers name on a five-year contract. BetMGM has no license to apply for in sports betting, casino, or poker here, because none of the three is open to competing operators.

One platform, three casino skins: Delaware Park, Bally's Dover, and Harrington Raceway each have an online casino “skin,” but all three run on the same BetRivers platform under the Lottery's contract. There is no separate BetMGM Casino skin to request.

The MGM Footprint That Isn't There

In Texas, BetMGM got ahead of the law entirely, signing the Houston Astros to a market-access deal years before sports betting was legal — a bet that paid off because no operator held a license yet. Delaware doesn't offer that kind of opening. The Lottery, not the casinos, picks the state's one online vendor, so there is no license queue for BetMGM to get ahead of. And unlike states where BetMGM leans on an MGM Resorts property to anchor its casino product, Delaware has no MGM casino to lean on: Delaware Park has been owned by Clairvest Group and Rubico Gaming since November 2021, and Bally's Dover carries the Bally's Corporation name. Neither racino has ever had an MGM Resorts ownership tie.

Is BetMGM Legit in Delaware?

As a company, yes — the MGM Resorts/Entain joint venture runs licensed sportsbooks and casinos in 23 states plus D.C. and posted roughly $2.8 billion in net revenue in 2025. Delaware having no BetMGM product isn't a mark against the brand; it's a consequence of a monopoly contract structure that locks out every operator who isn't Rush Street Interactive, FanDuel and DraftKings included.

What a real opening would look like: House Bill 4074 would have let the Lottery license up to five mobile sports betting operators, each paying a $500,000 annual fee and a 15% tax on gross gaming revenue. It passed the House 100-11 in 2026. Senate Gaming Committee Chairman David Blount never scheduled a hearing — the second straight year a competitive-market bill died there without a floor vote.

How Safe Is It to Look for BetMGM in Delaware?

Safe in the sense that nothing happens — BetMGM's geolocation checks the same license roster everywhere, and a Delaware signal doesn't clear because there's no Delaware license behind any of its products to check against. The actual regulated option for sports, casino, or poker in Delaware is BetRivers, running under the Lottery's own contract — not a workaround into an app that has never been authorized to operate in the state.

Bottom line: Delaware isn't a “not yet” state for BetMGM so much as a “not under this market structure” state, across all three products the brand runs elsewhere. Treat BetRivers as the only legal option here, and treat any gambling as entertainment spending, not income. 21+ only; the Delaware Council on Gambling Problems helpline is 1-888-850-8888.
