Underdog launched in Brooklyn in 2020 — eleven years after FanDuel, with a different contest format (pick’em instead of salary-cap) but the same non-sportsbook starting point. Underdog eventually built its own real-money sportsbook too, following the same path FanDuel had taken years earlier. The difference is what happened next.
Same move, opposite result. FanDuel’s sportsbook, launched years after its DFS product, is now the company’s primary identity. Underdog’s sportsbook, launched years after its own DFS product, closed nationwide in December 2025 — Underdog settled every open North Carolina wager and walked away from the category rather than keep chasing licenses.
Is Underdog Legit Without a Sportsbook to Point To?
Yes, but it is answering a different question than FanDuel is. FanDuel’s legitimacy rests on a public parent company and 24 state gaming licenses. Underdog’s rests on six years of paid DFS entries, a $17.5 million New York settlement in March 2025 that it paid rather than fought, and a brand-new federal registration stack — Designated Contract Market, Derivatives Clearing Organization, Futures Commission Merchant — behind Underdog Predict, launched July 2026. Closing a sportsbook on its own terms, with every open wager settled, is not the same as being shut down by a regulator.
Is FanDuel Safe Where Underdog Is Not an Option?
In FanDuel’s 24 licensed states, yes, to the extent regulated US sports betting gets safe: a named state license, geolocation, self-exclusion tools, and a public parent that answers to the NYSE and LSE. That safety case does not extend to California, Texas, or Florida — FanDuel Sportsbook simply is not there. Underdog was never a workaround for those dark states either; its DFS products run under a separate exemption with their own state list, and its sportsbook, while it existed, never covered the states FanDuel misses.
Which One for Who
Want a moneyline, spread, or parlay against a house line, and you live in one of FanDuel's 24 licensed states plus D.C.: FanDuel is the one of these two brands still built for that. Want pick’em contests against a posted projection instead: Underdog, checking first whether Classic Pick’em or Pick’em Champions is actually live where you are. Curious about a federally licensed prediction-market product neither company offered a few years ago: that is Underdog Predict, closer in structure to Kalshi than to either brand’s original DFS pitch.
