BetMGM Kentucky has operated as a licensed, mobile and retail sportsbook since September 28, 2023. Is BetMGM legal, legit, and safe for a Kentucky bettor today? Yes on all three — but the license underneath the app doesn’t run through any MGM Resorts casino. Kentucky doesn’t have one. Instead it runs through a horse track in Ashland that a tribal gaming operation helped build.

Is BetMGM Legal in Kentucky?

Yes. Kentucky legalized sports wagering under House Bill 551, which Gov. Andy Beshear signed on March 31, 2023, after the legislature had rejected similar bills in prior sessions. Retail sportsbooks at licensed racing facilities opened first, on September 7, 2023. Mobile wagering followed three weeks later, on September 28, with BetMGM among the apps live on day one. The Kentucky Horse Racing Commission (KHRC) has licensed and overseen the market continuously since.

Is BetMGM Legit in Kentucky? The Tethered-Track Model

Kentucky built its sports-betting law around the state’s horse-racing industry: every mobile sportsbook has to partner with a licensed racing association rather than get its own freestanding license. BetMGM’s partner is Revolutionary Racing Kentucky (RRKY), and its retail sportsbook is a 5,200-square-foot space inside Sandy’s Racing & Gaming in Ashland.

The Cherokee connection: Sandy’s Racing & Gaming, the $75 million facility that houses BetMGM’s retail Kentucky sportsbook, was developed by Revolutionary Racing in partnership with the Eastern Band of Cherokee Indians — the tribe behind Harrah’s Cherokee casinos in North Carolina. A quarter-horse track is planned on adjacent acreage, with racing slated to start running in 2025 to anchor the gaming license long-term. None of that involves MGM Resorts directly; it’s the licensing partner BetMGM needed to legally operate in a state with no MGM property at all.

That’s a normal consequence of Kentucky’s tethered model, not a red flag — every mobile operator in the state, not just BetMGM, has to attach itself to a racing license the same way.

Is BetMGM Safe to Use in Kentucky?

Yes. The KHRC requires geolocation to confirm a bettor is physically inside Kentucky before a bet can be placed, standard account and funds protections, and the responsible-gambling tools built into the app. The commission has also gone after operators over "risk-free" marketing language when a bettor’s own money is actually on the line — evidence it is enforcing conduct rules, not just collecting license fees.

No Online Casino, and a New Tax on Your Winnings

House Bill 551 legalized sports wagering only. There is no legal online casino market in Kentucky of any kind, so "BetMGM Casino" — live in Michigan, New Jersey, Pennsylvania, and West Virginia — has no Kentucky equivalent and no bill currently moving to create one.

What the state actually collects: Kentucky taxes online sports-wagering revenue at 14.25% and in-person wagering at 9.75%, with proceeds earmarked for the state’s public pension obligations. In March 2026 alone, the state’s online sportsbooks reported about $28.2 million in combined gross gaming revenue and remitted roughly $4 million in excise tax — with online betting making up nearly 98% of all wagers placed. Separately, starting with the 2026 tax year, Kentucky applies its flat 3.5% state income tax to gambling winnings, on top of the IRS’s 24% withholding on bets that net more than $5,000 at 300-to-1 odds or longer.

Who It Fits

Kentucky bettors 21 and older get a genuinely licensed sportsbook, even though the paperwork behind it runs through a racetrack and a tribal gaming partnership rather than an MGM casino. Treat any wager as entertainment spending, not income — and remember the state now wants its share of whatever you win. If gambling stops being fun, call 1-800-GAMBLER.
