Is Polymarket Legal in Germany? What the GGL Actually Ruled

Germany centralized online gambling enforcement under the Gemeinsame Glücksspielbehörde der Länder (GGL) on January 1, 2023, applying the Glücksspielstaatsvertrag 2021. The treaty licenses exactly four online verticals — sports betting, virtual slot machines, online poker, and horse-race betting — and even within sports betting, only wagers with objectively verifiable results qualify. On September 5, 2025, the GGL published a warning that went further than a general statement: it named Polymarket directly and classified its event contracts on non-sporting outcomes as illegal gambling, full stop.

Why the Ukraine War Bets Triggered the September 2025 Warning

The warning did not come out of nowhere. German outlets had been reporting on a rise in what the GGL called “entertainment-type bets” on the trajectory of the Russia-Ukraine war — when a ceasefire might land, how territory might change hands — trading on Polymarket’s event-contract format. The GGL’s response was blunt: these markets are “particularly susceptible to manipulation, as they are often based on unclear, subjective, or controllable events,” and a war’s outcome is about as subjective and controllable an event as a regulator can point to. That framing is why the warning named Polymarket specifically rather than prediction markets as an abstract category.

Not an ISP block. Unlike Australia, where ACMA directed internet providers to block Polymarket outright, the GGL’s September 2025 action was a public warning, not a network-level order. Polymarket’s close-only status for Germany is the company’s own response, made after the warning landed.

The Same Law Hit Kalshi Too — But Only Polymarket Got Named

Kalshi runs the identical category of product in Germany’s eyes: sports and politics event contracts sitting under the same GlüStV 2021 analysis that made Polymarket’s Ukraine markets illegal. As of this writing, the GGL has not issued a Kalshi-specific warning, and Kalshi has not moved Germany to close-only status the way Polymarket has. That is not evidence Kalshi is in a cleaner legal position — it is evidence that one platform had a specific, reportable story (war bets, named outlets, a public warning) and the other has not yet had its moment in front of the regulator. Enforcement sequencing, not legal distinction, explains the gap.

Is Polymarket Legit, Given the GGL Warning?

Worth separating, the same way this site treats every Polymarket country page. The GGL’s finding is about a product category — non-sports event contracts — not about whether Polymarket pays out on resolved markets. The platform has settled enormous volume globally, war-outcome markets included, without a payout scandal attached to its name. Legit as an exchange and licensed to serve German consumers are two different facts, and the September 2025 warning only settles the second, against Polymarket.

Is It Safe to Route Around Germany’s Close-Only Status?

No. Faking a non-German location to open a new position breaks Polymarket’s own terms of service on top of the German legal question, and a flagged account can be frozen with no BaFin, no GGL, and no Polymarket support channel obligated to help. The June 17, 2026 joint declaration among Germany and eight other European regulators — committing to shared intelligence and coordinated fines, blocks, and account freezes against prediction-market platforms — is a sign enforcement is heading toward more coordination, not less.
